Contending that marriages by a rabbi are legal without the formality of a license, Attorney Jacob Legion Tenney appeared before Superior Judge Joseph Sabath with Mrs. Miriam M. Paskind, 72 years old, who had just filed suit for separate maintenance from Benjamin Paskind, 76 years old.

Judge Sabath issued an order restraining the aged husband from evicting his wife from her home.

Thousands of Jews are married without licenses, Attorney Tenney said, and a decision on the Paskind case will affect all such marriages. Paskind claimed that the religious ceremony was not legal and he wanted the judge to annul his marriage. There will be a decision in a few days.
