The constitutionality of the aid-to-education act, signed into law Sunday by President Johnson, providing benefits for parochial as well as public schools, will be challenged by the Protestants and Other Americans United for Separation of Church and State, the organization announced here today. Earlier this week, the American Jewish Congress said that it would seek court action in blocking the payment of funds to church-related schools.

In reporting plans to test the constitutionality of the law, Glenn L. Archer, executive director of the church-state separation group, said that “the American people deserve a judicial review of certain provisions of this law which would appear to undermine church state separation in the United States. They are going to get it.”
