While the League for Freedom and Human Dignity today appealed to the Bavarian Government for a fair trial for Dr. Philip Auerbach, onetime head of the Bavarian Restitution Office, it became known here that his trial has once again been postponed, this time until April or May. Dr. Auerbach, who has been in prison for over a year, is charged with fraud in office.
Meanwhile, a meeting of the Bavarian Section of the Social Democratic Party of Germany, has criticized the decision of the highest provincial court refusing to permit Dr. Auerbach to testify before a state Parliamentary investigating commission. Dr. Josef Mueller, Bavarian Minister of Justice, has announced that the court decision will stand despite the threat of the Parliamentary commission to carry the matter to the Federal Constitutional Court at Karlsruhe.
